TERMS AND CONDITIONS OF USE

Preamble

By continuing to browse our Site hts-learning.com (hereinafter "the Site"), visitors to the Site (hereinafter "Users") accept without reservation the provisions and terms of use set out below (hereinafter referred to as "T&C"). Before using any of the features of our Site, the User acknowledges having read and accepted these T&C.

The currently online version of our T&C is the only one enforceable throughout the entire period of use of the Site and until we replace it with a new version.

The Site is managed by SAS DotDev (hereinafter "the Publisher") which reserves the right to modify these conditions at any time. Any use of our Site after modification of the T&C constitutes the User's irrevocable acceptance of the new version. In case of disagreement with our T&C, the User is requested to no longer use our Site.

ARTICLE 1 – DEFINITIONS

On our Site, the following terms have the following meaning:

  • Content”: means all the elements constituting the information present on our Site (texts, images, videos, algorithms, software, widgets, etc.) and allowing its operation, informing the User and presenting our services;
  • Intellectual Property Rights”: means all intellectual property rights and related rights (copyright, trademark rights, patent rights, trade names, databases, etc.) as protected by the French Intellectual Property Code created by law n°92-587 of July 1, 1992, whose version in force is the one applicable at the time of the User's consultation of the Site;
  • Publisher”: means the company SAS DotDev, whose registered office is located at 370 Route de Puechabon 34380 Viols Le Fort, registered with the Montpellier RCS under No. 935 327 932 00015;
  • Features”: means all the features made available to our users through our Site;
  • Site”: means the website www.hts-learning.com operated by the Publisher and made available to the User;
  • User”: means any individual using our Site and having access to its content.

ARTICLE 2 – LEGAL NOTICE

Pursuant to law n°2004-575 of June 21, 2004 on confidence in the digital economy, the identity of those involved in the creation and monitoring of our Site is hereby provided to the users of our Site:

ARTICLE 3 – PROTECTION OF PERSONAL DATA

For the use of our Site, we will process certain personal data relating to Users. Such processing is carried out in compliance with law n°78-17 of January 6, 1978 as amended relating to information technology, files and freedoms (known as the “Data Protection Act”) and with the Data Protection Policy available in the corresponding tab on our Site.

ARTICLE 4 – ACCESS TO THE SITE

Access to the Site and its use are reserved for strictly personal use. The User undertakes not to use the Site and the information or data contained therein for commercial, political, advertising purposes or for any form of commercial solicitation, in particular the sending of unsolicited emails.

The Publisher cannot be held responsible in the event of access to the Site by minors nor can it be held responsible in the event of incorrect or misleading information provided by the users of the Site.

ARTICLE 5 – DESCRIPTION OF THE SERVICES PROVIDED

We strive to provide as accurate information as possible, but we are not responsible for omissions, inaccuracies or deficiencies in the updating of information. All the information provided on our Site is given for information purposes only and is not exhaustive, and is subject to changes that may have been made since it was put online.

ARTICLE 6 – INTELLECTUAL PROPERTY

Our website

All trademarks, photographs, texts, comments, illustrations, animated or non-animated images, video sequences, sounds, as well as all computer applications that could be used to operate the Site and more generally all elements reproduced or used on the Site are protected by current laws relating to intellectual property.

They are the full and entire property of the Publisher or its commercial partners. Any reproduction, representation, use or adaptation, in any form whatsoever, of all or part of these elements, including computer applications, without the prior written consent of the publisher, is strictly prohibited. The fact that the publisher does not initiate legal proceedings as soon as it becomes aware of unauthorized use does not constitute acceptance of such use and waiver of prosecution.

It is strictly forbidden for the User to:

  • Copy, reproduce, represent, broadcast, distribute, publish, permanently or temporarily, all or part of the Content and/or the Site by any means and on any media known or unknown to date;
  • Create derivative works from the Content and/or the Site;
  • Modify, translate, adapt, arrange all or part of the Content and/or the Site;
  • Disassemble, decompile, or perform reverse engineering on the Site.

In all circumstances, the User is solely responsible for the use he/she makes of the Site. Any unauthorized use of the Site or any of the elements it contains will be considered as an act of infringement and prosecuted in accordance with the provisions of Articles L.335-2 et seq. of the French Intellectual Property Code.

Our brand

The verbal and visual trademarks (logos) of the Publisher as well as HTS Learning are protected. Their use without the written authorization of the Publisher or its partners on any medium, for the purpose of promoting products or services, or for commercial purposes, is prohibited under penalty of criminal and civil proceedings initiated by the Publisher against the user and/or the responsible third party.

Content

Content is freely accessible on the Site. Posting this content does not imply any transfer of copyright or property rights to the content, which remains the full and entire intellectual property of the Publisher and its contributors.

No User may or should take any measure(s) that is (are) incompatible with respect for copyright and intellectual property or that goes against any other French and international law governing intellectual property. The Publisher and its contributors reserve the right to prosecute any User for any violation of these provisions.

ARTICLE 7 – MANAGEMENT OF THE SITE

Our Site is normally accessible at all times to users. For the proper management of the Site, the Publisher may at any time reserve the right to:

  • Suspend, interrupt or limit access to all or part of the Site, for any reason, with or without notice, at its sole discretion;
  • Delete any information that may disrupt its operation, for any reason, with or without notice, at its sole discretion;
  • Suspend the Site in order to carry out updates.

ARTICLE 8 – LIABILITY

Site access

The Publisher undertakes to make every effort so that the Site is accessible 24/7. However, the Publisher makes no commitment regarding the permanent availability and accessibility of the Site and does not guarantee that the Site is error-free. The Publisher cannot be held liable in the event of failure, breakdown, difficulty, or interruption of operation preventing access to the Site or to one of its features.

The Publisher and the host cannot be held responsible in the event of an internet network malfunction, telephone line malfunction, or computer and telephone hardware malfunction in particular due to network congestion preventing access to the server.

The Publisher cannot be held liable in the event of legal proceedings against users:

  • Due to the use of the Site or any other service accessible via the internet;
  • Due to the non-compliance by the user with these T&C.

Equipment used

The connection equipment used by the User is under his/her sole responsibility. The User must take all appropriate measures to protect his/her equipment and own data. The User undertakes to access the Site using recent equipment, free from viruses and with a recently updated browser.

The Publisher is not liable for damage caused to Users, to third parties and/or their equipment resulting from their connection to or use of the Site, and Users waive any action against the Publisher on that account.

The Publisher can also not be held liable for indirect damages (such as loss of market or loss of opportunity) resulting from the use of the Site.

ARTICLE 9 – APPLICABLE LAW

These terms of use of the Site are governed by French law and – in the event of a dispute – subject to the exclusive jurisdiction of the competent ordinary courts, subject to a specific attribution of jurisdiction arising from a particular legal or regulatory text.
